Mount Rushmore was completed in 14 years, the White House in 13 years and the Parthenon in 17 years. Now here we sit 22 years later and the Viewpoint Master Plan has still not been completed. Viewpoint is NOT a success story! Residents in Viewpoint do not have four separate parks and trails, totaling over 40 acres, nor a community center, nor an area for public services, all as defined in the original ordinance. Residents have been deprived of these recreational and social enjoyments because the Town of Prescott Valley failed to monitor and enforce the contractual agreement and the Viewpoint Development managers dropped out before completion.
As William Ball stated in his recent article, “The original development agreement–converted to a town ordinance–expired…” Mr. Ball is correct, the ordinance has defaulted and expired, and as Ordinance no. 354 reads, “In the event of non-compliance with any of the above conditions, the zoning designation for all of the described rezoning area shall automatically revert from R1L-10 PAD, R1M-10 PAD, RS-3 PAD AND RS-4 PAD (respectively) back to the original designation of RCU-70.” Arizona law provides that a protected development right for a phased development is seven years. We are well past that threshold and everything has changed. Mr. Ball and the Town of Prescott Valley Zoning staff need to go back to square one and work with the community in achieving what is best for Prescott Valley and the residents of the Viewpoint community.
