Trial is one of 1st under new death penalty rules

PRESCOTT – Homer Roseberry, an Indiana man facing the death penalty for a homicide in Yavapai County, will stand trial in December.

Yavapai County Superior Court Judge William Kiger reset the trial date for Dec. 4 on Tuesday. The court had to abandon the first trial date in June because of a United States Supreme Court ruling that declared the death penalty sentencing process un-constitutional in several states, including Arizona. The high court ruled that a jury, not a judge, should determine whether a death penalty case involves aggravating factors.
