Dewey-Humboldt council to ponder approval for impact fees and new magistrate

At its meeting this week, the Dewey-Humboldt Town Council will decide whether to approve an ordinance that would implement revised development impact fees.

Tuesday at 6:30 p.m. inside Town Hall, 2735 S. Highway 69, council members also will consider whether to appoint Judge Catherine J. Kelley as the town municipal court's new presiding magistrate.

A council subcommittee this past Thursday interviewed four finalists for the magistrate position and unanimously chose Kelley, who's a former chief prosecutor for the Town of Gilbert, a Phoenix suburb, and lives in Dewey-Humboldt.

If the council agrees to the impact fees ordinance, the town would like to start assessing the fees in 2010 to offset costs associated with providing necessary public services, such as road upgrades, for new development.

Town Manager William Emerson said that although state law appears to have put a moratorium on impact fees, town staffers agree with the League of Arizona Cities and Towns that the law is invalid.

The league is litigating the issue and the town hopes to have a resolution of any controversy prior to the date the new fees begin coming due. If adopted, the new development fees will start on Feb. 1, 2010.

IN OTHER BUSINESS, the council plans to:

• Approve the canvass of the Nov. 3 special election for the town's General Plan, which voters rejected for the second time in as many years, and discuss the plan's future.

• Hear a report about the results generated from an Oct. 16 community workshop, called a charette, that outlined possibilities for refurbishing Humboldt's Main Street district.

• Hear a report from Emerson about recent results from the town's community outreach and code compliance efforts.

• Hear a report from Emerson about the outcome of the town's November discussions with the Arizona Department of Transportation regarding the speed limit at the Highway 69 and Main Street intersection.
