A Chino Valley man was indicted on bestiality and aggravated assault charges Thursday in early disposition court after he allegedly sexually assaulted a neighbor's dog.
A case management conference is set for Gary Riley, 38, of Chino Valley at 10:30 a.m. Feb. 16 before Yavapai Superior Court Judge Thomas B. Lindberg, said Penny Cramer, administrative assistant for the Yavapai County Attorney's office.
Yavapai County Sheriff's deputies arrested Riley at his home after 5:24 p.m. on Jan. 7 after they spoke with his neighbor, Levi Federwisch.
Federwisch told deputies when he came home from work he noticed his 6-month-old female border collie Daisy missing from his fenced backyard and not inside the house.
Federwisch told deputies he looked for his dog, then came home and saw Riley sexually assaulting Daisy.
Federwisch told deputies he briefly struggled with Riley to free Daisy.
After speaking with Federwisch, deputies knocked on Riley's front door and identified themselves, but no one answered. After finding the back door ajar, deputies knocked, announced themselves again and entered Riley's home.
Deputies found Riley hiding under a bed, said Dwight D'Evelyn, spokesman for the Yavapai County Sheriff's Office.
Deputies saw a mark on Riley's face that he said happened when a man punched him.
After deputies arrested Riley on charges of aggravated assault, they took him to their patrol vehicle, where Riley told them he'd drank 12 bottles of Budweiser beer, a violation of his parole.
Riley told deputies when he saw the dog on his property, he picked her up so he could return her; then a man started yelling and hit him without being provoked.
When the man said he was calling police, Riley told deputies he became frightened since he'd just been released from prison and was on parole.
Riley said he went inside his home, took a shower and hid under the bed.
Deputies took Riley to the Prescott substation, where he consented to a search of his body for marks.
Riley had multiple scratches and scrapes on his arms, front torso, lower back, chest abdomen and pelvic area that were consistent with a dog's claws, according to the Sheriff's Office report.
"Riley's injuries were consistent with what the owner of the dog said he had seen - Riley performing a sex act with the dog," D'Evelyn said.
Riley also consented to swabs of his mouth, which deputies submitted into evidence.
A doctor from the Chino Valley Animal Hospital examined Daisy and noted that the puppy had wounds that had happened in the past day on the interior of her vulva, according to the Sheriff's Office report.
The doctor noted Daisy was not in heat, and took swabs of her area, which deputies submitted into evidence.
Deputies booked Riley into the Camp Verde jail on charges of bestiality, aggravated assault and theft of property.
"Actually, these cases come up far more than you think they would," said Stephanie Nichols-Young, president of the Animal Defense League of Arizona. "It's very troubling."
"In some cases, smaller animals die or are horribly injured after they are violated. It is essentially rape."

My buddy's 90-something yr old grandpa told us a story about how he got in trouble for "accidentally" killing the prize hen when he was a youngster back in the old country. He laughed while he told it, almost as if he were proud. He also told us how no one took baths back then either: (in heavy Italian accent) "Everybody stank, so NOBODY stank!" Pretty gross.

i have lived in the area for 30 years, and it dose not matter where in the tri city are you live, every area has its fair share of sick people, hope this man rotts in jail, i do not want him near my children or my grand children, or any of your family for that matter

For those of us who work in social services in Yavapai County know, this behavior comes as no surprise. Unfortunately, the general public is not aware of how often it occurs due to privacy laws and regulations, unless there is an arrest. And no, it’s not exclusive to rural areas across the state. It happens everywhere. The perpetrator may have been a victim of incest or molestation as a child. No, it is not an excuse! However, as victims, especially with prolonged abuse, it is more likely that the victim, as he or she develops sexually, may develop perpetrator behaviors. Inappropriate sexual acting out in an adolescent is extremely difficult to treat, with mixed results. Furthermore, it is highly unlikely that these behaviors diminish as adulthood approaches. Not all victims go on to perp on others, but instead, turn their issues inward. I agree with Grundlecat who stated that animal cruelty charges should be added. Regarding Riley—are we going to be so naïve as to assume that he hasn’t acted out on others....fur or no fur? He is a 38 year-old man. This is NOT his first episode.

How come no animal cruelty charges? Seriously. He hurt the dog. She fought and tried to get away. Seems pretty clear-cut to me - and would help ensure he doesn't manage to adopt any pets in the future.
Aside from that, I say Poland has the right idea for offenders of this type: chemical castration upon release from prison.

In addition to posting comments online, we all should write letters to the courts demanding justice here. Maybe if the judge has a little pressure on him from the public, this guy will get put away for a long, long time. If we, as a community, just let this family deal with this alone, this guy may get away with it, because it was "just" a dog. We, as a community, need to stand behind Levi and his family and demand that justice be served...BIGTIME. If this guy gets away it, WHO'S NEXT? Really, everybody. This story should not go away until Gary Riley does. Remember his name. If he gets away with this, we will read about him again later. There is a special place in hell for people like this. My prayers are definately NOT with this idiot, but with Daisy and her family, and for all the other victims out there (two-legged and four-legged). What a FREAK.

To all, I think most are missing the point here. Justice was served, the police were called and responded. To guess at why and point fingers at porn, sexual oppression, the health care system?, is all really pointless. If this had never happened before the word beastiality wouldn't exist. More to the point, since about the dawn of humans there have been (these)... people. Yes men, but plenty of women as well. Elizabeth Borden, Hitler, Kane for a biblical reference, any mother who drowns their children, or female teachers sleeping with their pre-teen students, etc. I suggest an island where these (people) can make their own rules and see if they all can get along. If not, well too bad. They made their choices. I believe with the threat of said island, there would be quite a few less repeat offenders. If they cannot stop themselves, well, enjoy your stay on the island. Less money spent on prisons and prisoners. More money for things focused on bringing communities back to the way they used to be. I'm not sure about anyone else but I've noticed in my short years a severe decline in trust and concern for one's neighbors. It bothers me and I truly hope it bothers others too.

Of course, if/when, he repents and turns from his evil ways he'd be welcomed into the church of God; (even now he's being embraced through prayers). (Keep in mind, however, the spiritual/mind state, in which this man is now in, he'd be the first to tell you he'd want nothing to do with God). Also note, church, not being a structure, but rather of the Body of Christ. In the meantime, its the responsibility of all true church, (Christian), members to fast, pray and visit him in prison. To answer your other question: We are all created by the Hand of God, but not all are His chosen ones. "Many are called - few are chosen." However, "He desires for none to perish." While those living in Prescott may not be saints, they are least human beings and not dog rapists.

Thank you Courier for publishing the story.
I know the owners of Daisy and can't even imagine how they felt. Will Levi and his family ever feel safe in their home with this person as a neighbor?
I am praying that the justice system works. No plea bargin, no slap on the hand; lock him up when convicted! If he is free, who knows what will be next? Meantime, citizens watch you kids but also your female animals!
